Kogi Government Appeals Ruling On Ohinoyi Of Ebiraland’s Removal

 

The Kogi State Government has filed an appeal before the Court of Appeal in Abuja, challenging the ruling of a state High Court that ordered the removal of Tijani Ahmed-Anaje as the Ohinoyi of Ebiraland.

The appeal was confirmed by Kogi Attorney General, Muzi Abdullahi (SAN), who is also the 2nd claimant in the case.

Justice Umar Salisu of the Lokoja High Court had, on Monday, nullified Ahmed-Anaje’s appointment following a suit filed by Daudu Adeku-Ojiah, Hussain Yusuf, and Abdulrahman Suberu, who contested the legitimacy of his selection by former Governor Yahaya Bello.

In response, Governor Ahmed Ododo and the state attorney general have challenged the verdict, arguing that the appointment process followed legal procedures and urging the appellate court to overturn the lower court’s decision.

The five grounds of appeal claim that the trial judge erred in law by relying on Exhibit P.O 4, an interlocutory ruling from 2006, which they argue does not apply to the current case. The appellants also contend that the judge lacked jurisdiction to rule on the matter and that the decision was against the weight of evidence.

The Kogi government is seeking a ruling that sets aside the lower court’s decision and dismisses the case filed by the respondents.
