Femi Falana SAN Denies Wike’s Allegation Over Supreme Court Defection Ruling

Renowned human rights lawyer Femi Falana SAN has strongly denied claims by FCT Minister Nyesom Wike, accusing him of misrepresenting a Supreme Court judgment on the defection of 27 Rivers lawmakers.
Falana: I Spoke Based on Verified Legal Facts
In a statement titled “I Did Not Lie Against the Supreme Court of Nigeria”, Falana clarified his position.
He stated that he referenced verifiable facts and ongoing litigation before the Federal High Court in Port Harcourt.
Falana emphasized that the apex court raised the issue of defection suo motu, meaning on its own motion.
He maintained that his comments did not distort or misrepresent the court’s decision.
Wike’s Accusation Sparks Legal Rebuttal
During a recent press briefing in Abuja, Wike had accused Falana of “lying on national TV” about the court’s ruling.
Wike warned that such statements could incite unrest, calling the lawyer’s remarks dangerous.
In response, Falana stated, “There are sworn affidavits and videos proving the defection of the 27 lawmakers from PDP to APC.”
He argued that these facts contradict Wike’s narrative.
Falana Questions Wike’s Legal Credentials
Falana also challenged Wike’s authority to comment on legal matters.
“Mr. Wike is the only life bencher in Nigeria who has never argued a case in any court,” he claimed.
He rejected Wike’s label of “television lawyer,” saying not winning every case doesn’t imply incompetence.
“Only corrupt lawyers win all their cases,” Falana added.
Right to Free Expression Is Protected
Falana concluded by reaffirming his right to express opinions on judicial decisions.
He cited Section 39 of the 1999 Constitution and Article 9 of the African Charter on Human and Peoples’ Rights.
“It is no crime to criticise court rulings,” he stated. “The law protects my freedom of expression.”
