Enugu State Moves To Regulate Fees For Rent Agents And Lawyers
A bill aimed at regulating fees payable to rent agents and lawyers in Enugu State has passed its first reading at the State House Assembly. Sponsored by Okey Mbah, representing Nkanu East State Constituency, the proposed legislation seeks to amend the existing “Landlord and Tenant Law, CAP. 101, Laws of Enugu State, 2024.”
Key provisions of the bill include setting a maximum fee of 10% for both rent agents and lawyers. It also aims to abolish the practice of “caution fees” often demanded by landlords but never refunded to tenants.
Section 3(3) of the bill states that agent fees for procuring accommodation should not exceed 10% of the rent. Similarly, Section 3(4) limits legal fees for preparing landlord-tenant agreements to 10% of the rent.
The bill proposes penalties for offenders, including a N500,000 fine or a six-month prison term, or both. Additionally, it seeks to prevent unjust evictions by establishing clear durations for eviction notices.
The legislation also requires property agents and managers to be certified by a relevant agency and empowers a government ministry or agency to make further regulations on housing and tenancy matters.
Lawmaker Okey Mbah expressed confidence that the bill would receive broad support from assembly members, aligning with the desires of Enugu State residents.
