Enforcement Of Fundamental Rights: Abuja Cleric Sues Senator Ali Ndume Over Alleged Brutal Assault And Threat To Life
An Abuja High Court has granted an application for injunction against Senator Ali Ndume, Mansur Jarkasa and CSP, Ibeh Chukwudi (DPO, Apo Legislative Quarters, from further violating the Fundamental Rights of one Imam Ibrahim Lawal (aka Malam Usama), who was allegedly brutalised, dehumanised, humiliated and threatened by the said Respondents, on the 17th of June, 2023.
Senator Ali Ndume, representing the Borno South constituency, was accused of brutally assaulting Imam Ibrahim Lawal (Mal. Usama), a respected cleric while leading prayers at the Apo Legislative Quarters Zone (B) Mosque in Abuja.
According to reports made available to The Metro Lawyer (TML) the incident started on Friday, the 16th of June 2023 where Senator Ndume and Mansur Jarkasa planned to remove the Imam by force.
The cleric stated that Senator Ndume and Mansur Jarkasa connived with their children and an unknown gang of men, for a meeting after the morning prayer on Saturday the 17th day of June, 2023 in which Senator Ndume directed that the Imam should be removed.
After the evening prayer, the Imam made a general comment on the way things need to be done, in accordance with the teachings of Islam. Soon after, the Senator who appeared visibly agitated, began disrupting the serene atmosphere by shouting and creating a commotion.
Imam Usama, who was leading the prayers, requested Senator Ndume to maintain decorum and respect the sanctity of the place of worship, but instead of heeding the cleric’s plea, the senator allegedly flew into a rage and ordered his gang to physically attack the Imam, in front of the horrified worshippers.
The cleric further explained that Senator Ndume, accompanied by his gang, subjected him to severe physical abuse, including punches, kicks, and verbal threats. The assault only ceased when other worshippers intervened and managed to restrain the senator and his gang.
The cleric sustained severe injuries and was rushed to Garki hospital for medical attention. The cleric also immediately reported the case at the nearest police station, but instead of Senator Ndume to honour the police invitation, the Imam was detained for six days from the 20th to the 26th of June 2023, by the DPO on the instructions of the Senator, even after his home was invaded and properties worth millions were destroyed by the Senator’s gang on the 19th of June, 2023. He was subsequently released on bail but was allegedly rearrested on the orders of the Senator, from the 12th to 14th of July, 2023.
An application for the Enforcement of his Fundamental Rights, was then filed on his behalf by his lawyers Likko & Associates before the Honourable Justice Hamza Mu’azu of Court 27 (Vacation court 2) of the FCT High Court, Maitama, Abuja. The matter has been adjourned to the 17th of August, 2023 for hearing of the substantive application.
