Court Halts Publication And Sale Of Dele Farotimi’s Book, Orders Seizure Of Copies

 

The High Court of the Federal Capital Territory (FCT), Abuja, has issued an interim order barring human rights lawyer and activist Dele Farotimi from further publishing, selling, or distributing his book, Nigeria and Its Criminal Justice System.

Justice Peter Kekemeke granted the order after hearing an ex-parte application by Kehinde Ogunwumiju, SAN, the managing partner of Afe Babalola’s law firm. The court directed Farotimi, along with agents, publishers, and distributors, to cease all activities involving the book, whether physical or digital, pending the hearing of a motion for interlocutory injunction.

The judge also instructed security agencies, including the Nigerian Police Force, State Security Service (DSS), and Nigeria Security and Civil Defence Corps, to seize all physical copies of the book wherever found. These agencies are required to submit an affidavit within 72 hours confirming their compliance with the court’s directive.

In a related development, the Oyo State High Court issued a similar order against Farotimi, restraining him or any associates from further printing or distributing the book. Justice Mufutau Adegbola granted the order following an ex-parte application filed by Adebayo Adenipekun, SAN, another senior partner at Afe Babalola’s law firm.

The Oyo court adjourned the hearing on the motion for interlocutory injunction to January 7, 2025, while directing Farotimi’s legal representatives to be notified of the proceedings.

The book, Nigeria and Its Criminal Justice System, has drawn controversy, prompting legal action from prominent figures in the legal community, citing concerns over its content. The court rulings underscore ongoing tensions surrounding the publication.
