Court Adjourns Fundamental Rights Suit By NBM Against Edo Government To June 23

The Federal High Court in Benin has adjourned the fundamental rights case filed by the Neo Black Movement (NBM) of Africa against the Edo State Government and others to June 23, 2025.
The NBM initiated the court action following the demolition of its International Secretariat in Benin City. The organisation alleges the demolition was unlawful and a violation of its fundamental human rights.
At Monday’s proceedings, the Applicant, NBM of Africa, was represented by Prince Eze Nwauwa, Esq., who led a legal team of over 30 lawyers. The court, however, limited appearances to five lawyers per party to ensure orderly conduct.
The Edo State Government, as the 1st Respondent, was represented by H. A. Bello, SAN, while Okoror Stephen, Esq., appeared for the 2nd Respondent. The 3rd Respondent did not have any legal representation in court.
Controversy arose when Bello, SAN, questioned whether court papers had been served on the 3rd Respondent. The court clarified that service was completed on June 2, 2025, but no response had been filed.
NBM’s lead counsel, Prince Nwauwa, also informed the court that he received several documents in court that morning. These included motions for an extension of time, counter-affidavits, and preliminary objections filed by both the 1st and 2nd Respondents.
Additionally, A. A. Orunkoya, Esq. (known as Tony Masaka), appeared in court and submitted a motion seeking to be joined as an interested party in the case. He also served his motion on the Applicant in court that morning.
After hearing the submissions, the court adjourned the matter to June 23, 2025. The adjournment will allow for hearing the motion filed by Orunkoya and for responses to the pending court processes.
The NBM continues to seek judicial redress for what it describes as a violation of its rights.
