Oklahoma: New Bill Seeks To Expand Revenge Porn Laws To Include AI-Generated Sexual Content

Representative Toni Hasenbeck, R-Elgin, has introduced a new bill aimed at expanding Oklahoma’s current revenge pornography laws to address sexual content created using artificial intelligence (AI).

Under existing laws, the nonconsensual distribution of pornography intended to harass or humiliate the subject is classified as a misdemeanor. House Bill 1364 seeks to amend these statutes to include AI-generated sexual content.

“AI has its uses, but it also poses very serious threats,” Hasenbeck stated. “The sharing of revenge pornography, whether real or created by AI, destroys a person’s sense of privacy and dignity, wrecks their mental health, and ruins lives.”

This is not the first legislative effort in Oklahoma to combat the misuse of AI in explicit content. Last year, House Bill 3642 made it illegal to use AI to create or view child pornography.

HB1364 is set to be considered in the upcoming legislative session, beginning February 3.

Hasenbeck emphasized the urgency of addressing the evolving risks associated with AI technology. “The rapid development of AI has brought an equally rapid development of threats,” she said. “Anybody with a smartphone could create a deepfake pornography video or photo using a screenshot from someone’s social media or dating profile. It’s critical that our existing laws keep pace with the risks posed by new technology to protect Oklahomans from exploitation and harassment.”

The proposed legislation highlights the growing concern over the misuse of AI in generating nonconsensual sexual content, aiming to provide legal safeguards against exploitation and to uphold personal dignity in the digital age.
