GPA Labels National Health Regulatory Agency Unconstitutional, Alleges National Health Act Enables Organ Trafficking

 

 

The Global Prolife Alliance (GPA) has raised concerns about the proposed National Health Regulatory Agency, arguing that it violates Nigeria’s constitutional provisions and longstanding practices. According to the GPA, the agency represents a significant constitutional breach in the devolution of powers.

In a petition to the National Assembly, GPA Chairman Dr. Philip Njemanze highlighted the group’s objections, stating that the regulation of healthcare facilities has traditionally been a state and local government responsibility, as outlined in the 1999 Constitution. The GPA argues that the proposed agency undermines this structure.

The GPA also accused the National Assembly of legalizing human organ trafficking through the National Health Act 2014. The organization claims that the Act contains loopholes that facilitate organ trafficking, particularly sections that allow organ harvesting without explicit consent. Dr. Njemanze pointed out that these provisions contradict the fundamental rights of donors and constitute a violation of Nigeria’s constitution and international human rights standards.

The petition, sent to President Bola Ahmed Tinubu and other top officials, calls for the repeal of the National Health Act 2014 and the establishment of an independent body to monitor and prevent organ trafficking in Nigeria.
