Breach Of Duty: Court Of Appeal Adjourns Case Between Etisalat And Pastor Nmadu Ken For Hearing

The Abuja division of the Court of Appeal has adjourned a case before it, Emerging Markets Telecommunications Ltd (ETISALAT) v. Pastor Nmadu Ken (APPEAL NO. CA/A/384/2019) to 6th of April, 2022 for Hearing.

Counsel for the Appellant, Rachael Faromo (Mrs), informed the court that she filed a motion for extension of time to file their Briefs of Argument in their Appeal and the Cross Appeal and sought for the leave of the court to move the application, noting that they had complied with the payment of cost ordered by the court against the Appellant (Etisalat).

In response, Nwabueze Obasi-Obi who led Morris Chijioke Duru for the Respondent/Cross Appellant (Pastor Nmadu Ken) said he would not object to the grant of the Motion but asked that cost be awarded yet again, against Etisalat.

The Counsel to Etisalat, Mrs Faromo pleaded with the Court for the cost not to be awarded against Etisalat, that the delay in filing their Appellant and Cross Respondent Briefs, was not deliberate.

The Appeal which was to be heard on that 18th January 2021, was consequently adjourned to the 6th of April, 2022 for hearing, resulting from the grant of the extension of time to the Appellant.
